Aqiqah and custom: the issue of compatibility of traditional practice and Sharia law in Islamic law
Abstract
This article examines the religious and legal nature of the practice of aqiqah performed on the occasion of a childʼs birth, its status in Islamic jurisprudence, and its relationship with the concept of urf (custom). Particular attention is given to the role of urf in the juristic tradition of Mawarannahr (Transoxiana), as well as the criteria for distinguishing customs that conform to the Shariʿah from those that exceed its prescribed boundaries
